1. Agreement to Terms

By accessing or using ZoneSniper ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

ZoneSniper provides domain monitoring and trademark protection services, including monitoring of top-level domains (TLDs), alerting for potential trademark infringement, and related security services.

2. Accounts and Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities conducted through your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Subscription Plans

ZoneSniper offers various subscription tiers (Basic, Standard, Premium) with different features and monitoring limits. Subscription fees are charged in advance on a monthly or annual basis.

3.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method.

3.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You will be charged the then-current subscription fee.

3.4 Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

3.5 Failed Payments

If payment fails, we will notify you and may suspend your account until payment is received. Accounts with past-due payments for more than 30 days may be terminated.

4. Service Description and Limitations

4.1 Monitoring Services

ZoneSniper monitors domain registrations across multiple TLDs and provides alerts based on rules you configure. We make commercially reasonable efforts to provide accurate and timely monitoring, but we do not guarantee detection of all potentially infringing domains.

4.2 Service Availability

While we strive for high availability, we do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance when possible.

4.3 Usage Limits

Your subscription tier determines the number of monitors, alerts, and API calls you can use. Exceeding these limits may result in service interruption until you upgrade your plan.

4.4 Email Delivery and Notifications

ZoneSniper delivers alerts and service notifications via email. You are responsible for maintaining a valid email address and ensuring our emails are not blocked by spam filters. We do not guarantee delivery of all emails and are not liable for missed alerts due to email delivery failures, spam filtering, or incorrect email addresses. Service-related emails (alerts, billing notifications, security updates) cannot be unsubscribed from while maintaining an active account. You may manage notification preferences through your account settings.

5. User Responsibilities and Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service in ways that send more requests than a human could reasonably produce
• Reverse engineer, decompile, or disassemble any portion of the Service
• Resell or redistribute the Service without our written permission
• Use the Service to send spam or unsolicited communications
• Submit false or misleading information

6. Intellectual Property

6.1 Our Rights

The Service, including all content, features, and functionality, is owned by ZoneSniper and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

6.2 Your Data

You retain all rights to the data you submit to the Service, including monitor configurations and trademark information. By using the Service, you grant us a limited license to use this data solely to provide the Service to you.

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We collect and use your information in accordance with applicable data protection laws, including GDPR and CCPA where applicable.

We implement appropriate technical and organizational measures to protect your data, but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

8. Disclaimers and Limitations of Liability

8.1 No Legal Advice

ZoneSniper provides monitoring and alerting services only. We do not provide legal advice regarding trademark enforcement, domain disputes, or related matters. Consult with qualified legal counsel for legal questions.

8.2 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• All potentially infringing domains will be detected
• Alerts will be delivered without delay

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZONESNIPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless ZoneSniper and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any actions taken based on alerts or information provided by the Service

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

If you do not agree to modified Terms, you must stop using the Service and may cancel your subscription.

11. Termination

11.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account dashboard or contacting support.

11.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the Service in a manner that could harm us or other users

11.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your data in accordance with our data retention policies. You remain responsible for any fees incurred before termination.

12. Dispute Resolution

12.1 Informal Resolution

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New Mexico, without regard to conflict of law provisions.

12.3 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZoneSniper regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
